Vestval Technologies Pvt Ltd ("Vestval", "we", "our", or "us") offers an AI-powered personal finance platform integrating spending, saving, borrowing, insuring, and investing, primarily designed for users in Bharat (India).

Important Note:
Vestval is not a bank, non-banking financial company (NBFC), registered investment advisor, tax consultant, or insurer.
Vestval provides financial orchestration, smart nudges, and partner access but does not independently offer financial products.

You may use Vestval only if you:

• Are at least 18 years old,
   
• Are legally competent under Indian laws,
   
• Agree to provide accurate, truthful, and updated information.
   

We reserve the right to suspend or terminate your account if eligibility conditions are violated.

You are responsible for:

• Maintaining the confidentiality of your account credentials.
   
• Ensuring all information provided is accurate and updated regularly.
   
• Promptly notifying Vestval of any unauthorized access to your account.
   

You acknowledge that actions taken through your account are deemed authorized by you.

Vestval provides:

• Personalized finance management dashboards,
   
• AI-driven suggestions ("nudges") for optimizing your financial life,
   
• Access to third-party services for loans, insurance, investments, and tax filing.
   

You understand that:

• Financial decisions made through the platform are your sole responsibility.
   
• Vestval's insights and nudges are informational, not certified advice.
   
• Partner products are governed by partner-specific terms and policies.
   

Your privacy is extremely important to us.
Vestval complies with:

• The Indian Digital Personal Data Protection (DPDP) Act, 2023,
   
• Account Aggregator Framework norms for financial data,
   
• Encryption and cybersecurity standards (AES-256 for data at rest, TLS 1.3 for transmission).

Vestval integrates AI systems (FinGenie AI) to provide predictive, advisory, and personal finance nudging.

You agree that:

• FinGenie's outputs are for informational purposes only.
   
• FinGenie may sometimes offer probabilistic (non-certain) recommendations.
   
• Vestval is not liable for financial decisions based on AI outputs without user validation.
   

Vestval connects users to third-party platforms (e.g., loan providers, tax filers, insurance aggregators, stock brokers).

You understand:

• Accessing third-party services via Vestval is at your discretion.
   
• Vestval is not responsible for third-party service quality, content, claims, refunds, or disputes.
   
• Separate agreements and KYC may be required with third parties.
   

• Loans: Eligibility, disbursement, and recovery terms are governed by the lending institution’s policies.
   
• Insurance: Vestval acts only as a marketplace — all claims are subject to insurer-specific terms.
   
• Wealth Services: Vestval does not directly manage, recommend, or control investment decisions.
   
• Tax Filing: Filing is facilitated through registered third-party tax intermediaries.
   

All rights, title, and interest in Vestval, including trademarks, software, AI models, designs, texts, and logos, are owned or licensed by Vestval.

You may not:

• Copy, modify, distribute, reproduce, sell, or create derivative works without prior written consent.
   
• Reverse engineer or decompile Vestval’s AI systems or source code.
   

You agree not to:

• Use Vestval for any unlawful activities, fraud, or money laundering.
   
• Interfere with or disrupt platform operations.
   
• Misuse any AI-generated content or outputs.
   

Violation of this section may result in immediate suspension, report to law enforcement, and legal action.

You acknowledge that:

• Financial products inherently carry risks (market loss, credit risk, insurance denial, tax penalties, etc.).
   
• Past performance of any financial asset is not indicative of future results.
   
• Tax laws and financial regulations may change over time, affecting your outcomes.
   

Vestval may suspend or terminate your account:

• For violation of these Terms,
   
• For fraudulent, abusive, or harmful behavior,
   
• To comply with legal obligations or court orders.
   

You may voluntarily delete your account by contacting support.

Data associated with deleted accounts will be handled per our [Privacy Policy].

To the maximum extent permitted under law, Vestval disclaims liability for:

• Any direct, indirect, incidental, or consequential losses,
   
• Any financial decisions or losses incurred by users,
   
• Any errors, delays, or service interruptions.
   

Total liability, if any, shall not exceed INR 5,000 or the subscription fees paid in the preceding 3 months, whichever is lower.

You agree to indemnify and hold harmless Vestval and its affiliates from any claims, liabilities, damages, losses, and expenses arising from your use of the Services, violation of these Terms, or violation of any rights of third parties.

These Terms are governed by the laws of India.
Disputes shall be subject to the exclusive jurisdiction of courts located in Mumbai, Maharashtra.

Vestval shall not be liable for any failure to perform due to unforeseen events beyond our reasonable control, including but not limited to natural disasters, cyberattacks, regulatory actions, or infrastructure failures.

We may update these Terms from time to time.
Material changes will be notified via email, app alerts, or website banners.

Continued use after changes means you agree to the updated Terms.

FinGenie is an AI system designed to offer personalized financial nudges, projections, and suggestions across spending, saving, credit, tax, wealth, and insurance.

• FinGenie outputs are probabilistic and advisory in nature.
   
• AI-generated suggestions may not always be accurate, complete, or fully personalized.
   
• AI predictions, tax saving estimates, loan offers, or wealth allocations must be independently validated by users.
   

While we constantly train and monitor FinGenie:

• AI outputs may occasionally be incorrect ("hallucinate").
   
• Financial decisions should not solely rely on FinGenie recommendations without user validation and/or third-party advisor consultation.
   

• FinGenie is not a certified financial, tax, or legal advisor.
   
• Outputs are for informational purposes only and do not constitute advice.
   
• FinGenie may not always reflect the latest regulatory changes immediately.
   

Users are solely responsible for any decisions made based on FinGenie suggestions.

Vestval is continuously training and improving FinGenie with user feedback, machine learning updates, and domain expertise.

Vestval Technologies Pvt Ltd operates with adherence to Indian fintech regulations, and is designed to be compliant with:

• Account Aggregator (AA) Framework by RBI and SEBI,
   
• Digital Personal Data Protection (DPDP) Act, 2023,
   
• KYC (Know Your Customer) and eKYC norms,
   
• RBI's Digital Lending Guidelines (for partner loans),
   
• Insurance Aggregator Guidelines (for insurance partnerships),
   
• Taxation APIs and Regulatory Reporting Norms (via GST and Income Tax APIs).
   

Vestval ensures:

• Data encryption at rest (AES-256) and during transmission (TLS 1.3),
   
• User consent management for data sharing (via AA standards),
   
• Full GDPR-inspired rights: Access, Correction, Portability, Erasure requests.
   

Vestval only integrates with:

• Resolution timeline within 15 working days,

Vestval intends to register under relevant regulatory categories (e.g., PISP, AISP licenses under AA Framework) as scale increases.
